Please read these Conditions of Use carefully before using this Web Site including our Interactive Web Services (referred to sometimes together as the “Web Sites”). You should review the Conditions of Use regularly as they may change at any time. References to "Web Sites" and "Sites" mean both the singular and plural of these terms. References to "you" or "your" shall mean the person authorized to access and use the Web Sites. References to "we", "us" or "our" shall mean the Company and, where applicable, affiliated member companies within the Sun Life group.

If you access and use the Web Sites, you accept and agree to be bound by the terms and conditions set forth herein as well as any changes to the terms and conditions that we may make from time to time. It is also agreed and understood that the use of these Web Sites is on your own initiative and you are responsible for compliance with applicable local, national or international laws. The Legal Information applies to owners of products and services (each an “Owner” or “Client”) provided by Sun Life Assurance Company of Canada (Bermuda Branch) in Bermuda or Sun Life Financial Investments (Bermuda) Ltd. in Bermuda (both companies referred to sometimes herein together, for convenience only, as “the Company”), as well as the distributor named on the account of the Owner. The Web Sites are administered by Sun Life Assurance Company of Canada (Bermuda Branch) in Bermuda, a member of the Sun Life Financial group of companies.

General

Nothing in our Web Sites or Interactive Web Services shall constitute an offer to buy or sell products or services of the Company or any affiliate. All products and services are subject to the terms and conditions of any applicable agreements governing their use, which may change from time to time.

Our products and services are available only in jurisdictions where they may be lawfully offered for sale. Not all products and services are available in all geographical regions. Participation in the international programs offered by the Company in Bermuda may be restricted, depending on residency or citizenship or other considerations established by the Company from time to time. Bermuda and Canada residents and United States residents or citizens are not eligible to participate. Residents of certain other countries may be subject to similar restrictions. These international products are registered only in Bermuda.

These Web Sites are for general informational purposes only. It is not intended to provide any personalized financial, accounting, tax, legal and/or market advice (including, without limitation, advice regarding the suitability or profitability of any insurance product, security or investment).  If you require advice, please consult with your own professional advisers.

Notice may be given to you in writing, by e-mail or by posting such notice on our Web Site.  You acknowledge and agree that the Company may immediately terminate your access to the Interactive Web Services (as described below) if you violate any of our Conditions of Use.

Your use of our Web Sites shall be entirely at your risk. The Company will not be responsible in any manner for any harm, loss or damage, however caused, arising out of your use of the Web Sites, including direct, indirect, special, third party or consequential damages. We will not be responsible for any detrimental reliance that you may place upon the Web Sites or its contents.

OUR WEB SITES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MECHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND THE WARRANTY AGAINST INFRINGEMENT WITH RESPECT TO THE INFORMATION PROVIDED AND THE USE OF THIS SERVICE. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

If any provision in these Conditions of Use is held invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The laws of Bermuda shall govern your use of this site. You hereby consent and submit to the jurisdiction of the courts of Bermuda in any action or proceeding related to your use of the Web Sites.

Products

The Company’s products are authorized for prospective clients only when preceded or accompanied by relevant disclosure material prepared by the Company and provided by an authorized distributor; depending on the product type, such materials may include a Specimen Policy/Certificate, Essential Information Product and Disclosure document, Offering Document and/or underlying fund prospectuses containing more complete information including all charges and expenses, such as premiums, cost of insurance rates,  withdrawal or surrender charges, and mortality and expense risk charges. They should be read carefully by clients before making any decision to purchase a product and before investing or sending money or premium payments.

Products are not insured by the FDIC or any other government agency, and are not deposits or other obligations of, or guaranteed by, any financial institution.  With respect to variable annuity or investment products, unit values are subject to investment risk, including possible loss of the principal amount invested, and will fluctuate in value. You may receive more or less than you paid when you redeem your units. Please see the Essential Information and Product Disclosure or Offering Document for details.

Sun Life Assurance Company of Canada (Bermuda Branch) is licensed to conduct long-term insurance business by the Bermuda Monetary Authority.  Sun Life Financial Investments (Bermuda) Ltd. is licensed to conduct Investment Business by the Bermuda Monetary Authority.

Interactive web services

Certain parts of the Web Sites require an electronic identification which may consist of a user name, Internet Personal Identification Number (commonly referred to as a P.I.N. or password), or other security measures that the Company may require. You agree that the use of this electronic identification is the legal equivalent to your written signed instructions to the Company and that your identity as an authorized user of our Web Site services is determined solely by your user name and Internet Personal Identification Number. You acknowledge that you are responsible for the safekeeping of your Internet Personal Identification Number and that the Company is unable, and under no obligation, to confirm the identity or authority of any user of our Web Site services.

You also agree that the Company has no duty to inquire as to the authority or propriety of any instructions given to it and shall be entitled to act upon any such instructions. If you become concerned that the confidentiality of your Internet Personal Identification Number has become compromised, you agree to notify the Company and change your Internet Personal Identification Number immediately.  To keep your policy or contract information confidential, you agree not to disclose your Internet Personal Identification Number or similar credentials to anyone and will not record it anywhere.  You agree to immediately notify the Company of any unauthorized use of your Internet Personal Identification Number or similar credentials and/or access to your policy or contract records.  The Company reserves the right to cancel or restrict the use of your Internet Personal Identification Number or similar credentials or restrict its use and/or the Interactive Web Services without notice and for any reason, including the reason of your use that is contrary to our Conditions of Use.

If you are a distributor of the Company’s products, you agree to keep your Client’s policy or contract information confidential, you agree not to disclose your Internet Personal Identification Number or similar credentials to anyone and will not record it anywhere. You agree to immediately notify the Company of any unauthorized use of your Internet Personal Identification Number or similar credentials and/or access to your Client’s policy or contract records. The Company reserves the right to cancel or restrict the use of your Personal Identification Number or similar credentials or restrict its use and/or our Interactive Web Services without notice and for any reason, including the reason of your use that is contrary to our Conditions of Use.

Any on-line acknowledgments or other messages which appear on your screen for transactions entered do not mean that the transactions have been received, accepted or rejected by the Company. These acknowledgements are only an indication that the transaction information entered by you has either been transmitted or cannot be transmitted to the Company. No transaction shall be deemed accepted until you receive a written confirmation from the Company. You are responsible for reviewing all confirmations and policy or contract statements received by you in order to verify their accuracy. If you do not receive a written confirmation within five (5) business days of a transaction, you agree to immediately notify the Company.

CustomerLink

The Company’s CustomerLink service permits Clients to view information about their certificate/account record, and receive other information related to their account through electronic transmission via a compatible personal computer and a secure Web browser.

Financial professionals

Certain parts of the Web Sites permit you, an authorized broker, distributor, or representative, to access information pertaining to your Clients’ insurance coverage, annuity and investment accounts for the sole purpose of maintaining ongoing contact with your Clients and to service their contracts or accounts. You may download information pertaining to your Clients and print out a hard copy in connection with providing client services. You are not authorized to, and agree not to use this service for any other purpose other than as provided herein. You acknowledge that information that you access through this service is highly confidential and you agree that you will use it accordingly and in compliance with all applicable laws. Certain parts of the Web Sites also permit you, an authorized broker, distributor, or representative, to access forms and marketing and educational materials. In addition to these Conditions of Use, your use of these parts of the Web Sites and materials are subject to the terms and conditions of any applicable sales, distribution, and appointment agreements, as well as the Company’s policies and procedures.

Online information

The information gathered and retained by us from your use of our Web Sites will be used by the Company and its affiliated group of companies only as permitted or required by applicable law. Your activity on the Web Sites will not result in you being added to a mailing list, unless you specifically request us to do so. We will not provide or sell any information about you to unpermitted third parties. Please see our Privacy Policy for more information on security and privacy matters regarding this use of the Web Sites and Interactive Web Services. Our Privacy Policy can be accessed over the Internet.

It is important to keep in mind, however, that the Internet is not a totally secure medium of communication. For this reason, we cannot guarantee the privacy of any information you input on the Web Sites or send to us on the Internet. The Company, including affiliates, will not be responsible for any damages you or others may suffer as a result of the loss of confidentiality of any such information sent over the Internet. Distributors will have access to information with regard to those accounts on which they are listed as the broker of record. Distributors, not the Company or any affiliate, are responsible to Owners for any misuse of account information accessed on our Web Sites. Owners should contact their distributor to discuss the terms of their access to account information.

Except as may otherwise be provided herein, users of the Company's Web Sites shall be entitled to copy information for their own noncommercial personal use but may not republish or reproduce any part without the prior written permission of the applicable Sun Life Financial company. Republishing and reproducing includes any uploading, downloading or accessing the information on our Web Sites onto the Internet or any other local or international computer system. An acknowledgement of the source must be included whenever our materials are copied or published.
